Employee handbook/Personnel manuals. Review current personnel policies and assist in revising or drafting additional policies in accordance with the employer’s specific needs and objectives, including but not limited to:

  • Equal Employment Opportunity (“EEO”) policies
  • Harassment policies and complaint reporting procedures
  • Nepotism and non-fraternization policies
  • Personal conduct policies
  • Internet and electronic mail usage policies
  • FMLA policies
  • Policies relating to the handling of benefits upon termination.

Employment contracts. Review current employment contracts and revise or draft new contracts which meet the employer’s specific goals, focusing on the employer’s need to protect confidential and trade secret information and the goodwill of its customers as well as to limit unfair competition by former employees.

Personnel records/Record retention practices. Ensure that personnel records are properly and appropriately maintained for sufficient periods of time. Formulate policies relating to providing references for current and former employees and employee access to personnel files.

Wage and hours regulations. Determine compliance with all applicable federal and state wage and hours laws, including assistance in determining positions exempt from overtime requirements.

Affirmative action plans. Formulate affirmative action plans and conduct the necessary statistical analyses and presentations to the Department of Labor. Assist employers with on-site audits and represention at any administrative hearing.

General counseling. Provide guidance and common-sense suggestions for handling day-to-day personnel matters, as well as complicated legal issues, which arise in the course of business.
