Education Law

The business of education has been an important part of our practice since the 1950s when two of our name partners, Lew Bose and Bill Evans, began providing legal services to schools. Education law is extremely complex and ever-evolving. Today, schools must address numerous issues ranging from contracts to inclusion to compliance with state and federal laws.

Our Education Law Group currently provides legal services to more than two-thirds of Indiana public schools. We not only help schools resolve legal issues, we also help them take steps to prevent them. Establishing and delineating clear policies and requirements for administrators, teachers and students and spelling out the consequences can often avert potential legal problems. Bose McKinney & Evans also understands that schools operate under a public microscope which creates different pressures for our clients.

Flexible arrangements fit the unique needs of each school corporation or district. For a comprehensive, cost effective approach to legal services, many school systems use our services to augment those of local counsel. Frequently, it is expedient for schools to use local counsel for routine matters and rely on us for specialized situations, such as teacher due process in which two legal counselors are required.

With our experience and services, we can help with numerous assignments, including:

  • Advising on collective bargaining and grievance arbitrations
  • Assisting with teacher contract cancellations
  • Handling special education issues
  • Consulting on state and federal civil rights compliance
  • Arbitrating school governance disputes
  • Arranging financing (bonding) for school construction
  • Handling construction disputes
  • Assisting with general litigation
  • Counseling on employee benefits

Our services are offered on a fee-for-services basis or an ongoing retainer basis. Schools often find that working with us on a retainer basis helps with budgeting. In addition, when we work with schools on a continuing basis, we build strong relationships with school officials and get to know their operations and particular challenges. Retainer clients also benefit from our support services including workshops, advisory newsletters and bulletins to alert them to rulings and regulations that could impact their operations. Our flexibility, experience and extensive services help ensure that clients receive the legal assistance they need in today's complex education environment.
