HIPAA

The deadline for HIPAA compliance was April 14, 2004. Virtually all employers, including companies, schools and municipalities, maintain at least one health plan that is required to comply with this new federal law.

Any employer that maintains a health flexible spending account (Section 125 plan) or any other self-funded group health plan needs is required to comply with the HIPAA Health Privacy Rule. The Health Privacy Rule radically alters the way that these plans may use and disclose protected health information.

Failure to comply with the Health Privacy Rule may result in significant civil or criminal penalties. In extreme situations, violators may be subject to fines of up to $250,000 and terms of imprisonment of up to 10 years.

Have You Complied with HIPAA?
