Design Patents: Basic Principles and
Recent Changes


In the United States, a design patent, unlike the more familiar utility patent, is intended to protect the aesthetic or ornamental features of an object or device, not the functional aspects of a device. “In general terms, a “utility patent” protects the way an article is used and works (35 U.S.C. 101), while a “design patent” protects the way an article looks (35 U.S.C. 171).” Thus, if protection of the appearance of a device is important, you should considered a design patent. Increase in Trademark Filing Fee
The United States Patent and Trademark Office fee for filing an application for trademark registration will be increased from $325.00 to $335.00 per International Class effective January 1, 2003. Therefore, all trademark applications filed after January 1, 2003 will require a $335.00 filing fee per International Class.
