NEW I-9 FORM On November 7, 2007, the U.S. Citizenship & Immigration Services issued a revised Employment Eligibility Verification Form I-9 and a new “Handbook for Employers, Instructions for Completing the Form I-9”. The focus of the revision is the removal from List A of five documents for proof of both identity and employment eligibility. The removed forms that no longer will be sufficient include: Certificate of U.S. Citizenship (Form N-560 or N-561), Certificate of Naturalization (Form N-550 or N-570), the old Alien Registration Receipt Card (Form I-151), the unexpired Reentry Permit (Form I-327), and the unexpired Refugee Travel Document (Form I-571). Additionally, the unexpired Employment Authorization Document (I-766) has been added to List A of acceptable documents. Pursuant to the instructions for the new I-9, providing a social security number in Section 1 is voluntary unless the employer participates in E-Verify, the USCIS Electronic Employment Eligibility Verification Program. The new Form I-9 with a revision date of June 5, 2007 is the only form that is now valid for use. Go to http://www.uscis.gov/files/nativedocuments/m-274.pdf for the “Handbook for Employers, Instructions for Completing the I-9 Form” which contains the new Form I-9 and color illustrations of examples of acceptable documents. If you require any assistance in developing an I-9 Employment Verification procedure, conducting internal audits of I-9 procedures or responding to other employment or employment related immigration issues, please contact Philip J. Ripani, (317) 684-5280, pripani@boselaw.com or Sandra Perry, (317) 684-5175, sperry@boselaw.com in the Labor and Employment Group at Bose McKinney & Evans LLP. | |
