On January 9, 2018, the Federal District Court in the Northern District of California issued a Preliminary Injunction requiring the federal government “to maintain the Deferred Action for Childhood Arrivals (DACA) program on a nationwide basis on the same terms and conditions as were in effect before the rescission on September 5, 2017.”
On January 13, 2018, U.S. Citizenship and Immigration Services (USCIS) announced that it has resumed accepting requests to renew a grant of DACA. Foreign nationals who were previously granted deferred action under DACA may be eligible to request renewal. USCIS is not accepting requests from individuals who have never before been granted DACA. USCIS will not accept or approve advance parole requests from DACA recipients.
Until further notice, the DACA policy will be operated on the terms in place before it was rescinded on September 5, 2017. USCIS notes that additional information will be forthcoming. More information can be found by visiting the USCIS website, www.uscis.gov.
