United States Citizenship and Immigration Services (USCIS) has announced plans to delay the effective date of the final rule that would alter the manner in which the H-1B lottery is conducted. As an update to the alert published earlier this week, Bose McKinney & Evans can confirm that this year’s “cap” season is expected to proceed in a manner similar or identical to last year’s registration process. The wage-based priority system will not be implemented this March.

The delay to the effective date of the wage-based priority system will be published in the Federal Register on February 8, 2021. The effective date will become December 3, 2021, giving employers and USCIS time to plan for the change.
